Forum: netlabels Subject: Question about Removed Items

Just curious - several Autoplate items are no longer availble due to "issues with the item's content". Marsen Jules "Yara", "Lazy Sunday Funerals", and Move D - "Live at Johanneskirche" for example. Could anyone elborate on this?

I think, in Germany, if an artist is signed with GEMA can't release on a netlabel and Marsen has various releases on cd possibly registered under GEMA, so, i guess the guys of Autoplate had to remove the items under legal requeriments.

You can release music by someone who's member of the GEMA, but the netlabel could have to pay for it each time someone downloads it (11,25 cts and 12,5 cts at the end of the year)

That sheds a little more light on the subject. Definitely a motivator to remove an item from a label's archives. So it's retroactive - even if the release was made available before the artist became a memember of GEMA?

yes, unfortunately; this is just the beginning of what will be
a rule here in europe; our governements are working in a similar way. that's the sad future for the netlabel scene.

Bad news to german netlabels, i think :(
In Russia here it is no laws like that.

I can say more: in 1st of September 2006 a new edition of "Author Rights" law was applied. Their says that an author can "publish his work to public" - it can be used as internet file piblishing...

I do not know how to traslate it properlly in English :(

Phonocake Netlabel also had to delete one release one time. It was because the artist got signed by a label, who wanted to bring all the artist's tracks to an big mp3-shop. We (phonocake) didnt want to have legal action with this firm, so we took all the tracks out of the catalogue and also from archive.org . In the end, the artist earned 200 Euros in 2 years with this adhesion contract. He was not in the gema.

That's odd. This only generally happens when label owners ask for removal, and even then it doesn't look like that.

Anyone from Autoplate around to comment? Is this just a bug? What are the exact URLs?

Oh, well maybe the Autoplate guys asked for them to be taken down then, and I just don't remember doing it.

Thanks. Maybe I'll just contact the label. I was just wondering under what circumstances a lnetabel would want to remove releases (especially such popular ones).
